Residents express concerns over the environmental impact of the data center project in Bessemer, Alabama.
A legal challenge has been filed against a controversial data center project in Bessemer, Alabama, due to community environmental concerns. Local residents demand a halt to the project, which they argue would disrupt the neighborhood and threaten local ecosystems, including endangered species habitats. The lawsuit also highlights procedural transparency issues related to zoning changes approved by the city. As the city council prepares to review the proposal, the residents hope for a resolution that addresses both economic benefits and environmental protection.
A new legal challenge has been filed against a controversial data center project in Bessemer, Alabama, aiming to address community concerns regarding environmental implications and procedural transparency. The legal filing, submitted by three local residents living near the proposed site, seeks a temporary restraining order and a preliminary injunction to halt the project immediately.
Residents argue that the project poses a significant disruption to their neighborhood and threatens ecologically sensitive areas, particularly Little Blue Creek and Five Mile Creek. The proposed data center is located on a 700-acre site near Rock Mountain Lake Road in Jefferson County. The complaint highlights potential threats to the habitats of endangered species, including the watercress darter and the federally protected bald eagle.
In addition to ecological threats, residents have raised alarms regarding expected issues such as increased noise, heightened traffic, and diminished water quality. Concerns were also raised about a lack of proper public engagement regarding the necessary zoning change from agricultural to industrial, which the planning and zoning commission previously approved in a 4-2 vote amid strong local opposition.
Central to the legal complaint is the contention that the city did not adequately notify residents about the zoning changes affecting their properties. The filing emphasizes the existence of a non-disclosure agreement signed by the mayor and other city officials, raising questions about transparency in the decision-making process. Witnesses have expressed that not all community members were given the opportunity to voice their concerns at the planning and zoning commission meeting prior to the project’s recommendation.
Logistic Land Investments LLC, the developer behind the project, has stated its commitment to adhering to existing noise ordinances and assured residents they would be kept informed about any studies related to the data center’s impact on the area. The developer claims the project will lead to the creation of high-paying and high-quality jobs in Bessemer and Jefferson County. This aligns with a broader trend as Bessemer and nearby regions have seen an uptick in data center developments, including company initiatives like those from DC Blox.
A public hearing on the project was scheduled for Tuesday; however, it remains uncertain whether it will proceed following the recent legal filing. The Bessemer City Council is slated to review the proposal for final approval, with its next meeting scheduled for April 1. Residents are anxiously awaiting the council’s decision, balancing economic hopes against their environmental and quality-of-life concerns as they contend with the challenges posed by rapid development in their community.
